Under consumer law, if a product or service breaks, is not fit for purpose or does not do what the seller or advertisement said it would do, you can ask for a repair, replacement or refund.
Repairs, replacements and refunds are known as remedies. The remedy you are entitled to can depend on the goods in question and other factors.
For products bought in a shop, you do not have a legal right to a refund because you change your mind. If you bought the goods online, in most cases, you have 14 days to change your mind and get a full refund.
Refunds
If you are entitled to a refund, the seller may offer to reimburse you in the following ways:
- Refund (sometimes called a cash refund) – This is a refund of the money you paid, usually to the original form of payment. For example, if you paid using a credit card or debit card the money will be refunded back onto the card.
- Credit note – This is usually a paper or electronic note that is given by the seller when goods are returned. It is like a voucher and can only be used to buy goods sold by that particular store or a chain of shops. You do not have to accept a credit note or a voucher if the good is faulty, is not fit for purpose or does not do what the seller or advertisement said it would do.
Under the CRD, you have 14 calendar days to change your mind without having to give a reason. This right to cancel is also known as the ‘cooling-off period’.
You must be refunded including standard delivery costs. A seller may not process the refund until they have proof that items have been sent back.
Delayed or non-delivery
The CRD sets out the following rules for delayed or non-delivery:
- You must receive your products within 30 days of buying them (unless you agreed to a different timeframe for delivery)
- If the products are not delivered within the time agreed, you can ask the seller to deliver the items again by an agreed date
- If the seller fails to deliver within this additional period, you can cancel the contract and get a refund of all the money you paid without delay
- If, at the time of buying the goods, you told the seller that delivery by a certain date was essential (for example, for an event) and the seller agreed, you can cancel the contract and get a refund if they fail to deliver as promised
- You can also cancel the contract and get a refund if the seller has stated that they cannot or will not deliver the goods
Faulty goods
Under the Sale of Goods and Supply of Services Act, 1980 all products must meet certain conditions of quality, performance and durability. This means that when you buy something it has to be:
- Of satisfactory (merchantable) quality - this means of reasonable and acceptable standard, taking into account other factors such as durability and price
- Fit for the purpose you bought it for – they should work and do what they are reasonably expected to do
- As described - they must match any description given in an advert or other information provided by the seller at the time of sale
Please note that the dispatch and delivery of items will take up to 15 working days from the time of the placet order or purchases. We are now offering free standard delivery for all orders inside ROI until Christmas.
Please note that we are producing items and they are always available but because of the amount of job, orders, and Covid19 situation (work from home), all orders need to be confirmed 5 days before collection. We don’t do stock up items, we are producing them for the order. Every collection is scheduled by time because of your and our safety.
